1. Acceptance of Terms

By accessing or using KrisAI AdCraft ("Platform", "Service") at https://app.krisai.co, you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not access or use the Platform.

2. Description of Service

KrisAI AdCraft is an AI-powered advertising platform that enables users to generate, manage, and deploy ad campaigns across Meta (Facebook/Instagram), Google Ads, and LinkedIn. The Platform uses AI models (including Anthropic Claude, OpenAI, and fal.ai FLUX) to generate ad copy, images, and audio voiceovers based on user inputs.

The Platform is designed for three specific verticals: Attorneys, Real Estate professionals, and B2B/SaaS companies. Features include campaign management, lead tracking, brand voice training, analytics, and multi-platform publishing.

3. Accounts & Registration

  • You must be at least 18 years old and legally capable of entering a binding contract.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the security of your account credentials. Notify us immediately at legal@krisai.co if you suspect unauthorized access.
  • You may not share your account with others or create accounts on behalf of third parties without our prior written consent.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans & Billing

4.1 Plans

KrisAI AdCraft offers Starter ($97/mo), Pro ($247/mo), and Agency (custom) subscription plans. Plan details, including feature limits, are described on the pricing page and may be updated from time to time with notice.

4.2 Free Trial

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid plan unless you cancel before the trial ends.

4.3 Billing & Renewals

  • Subscriptions are billed monthly in advance and automatically renew unless cancelled.
  • All fees are in USD and exclusive of applicable taxes.
  • You authorize us to charge your payment method on file for all amounts due.

4.4 Refunds

All payments are non-refundable except where required by law. If you believe you were charged in error, contact legal@krisai.co within 14 days of the charge.

4.5 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.

5. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable laws, regulations, or third-party rights
  • Generate content that is defamatory, discriminatory, harassing, obscene, or fraudulent
  • Create ads that violate Meta, Google, or LinkedIn advertising policies
  • Violate applicable advertising regulations, including the ABA Model Rules (for attorneys) or Fair Housing Act (for real estate)
  • Impersonate any person, entity, or brand
  • Introduce malware, viruses, or harmful code
  • Reverse-engineer, decompile, or attempt to extract source code
  • Use the Platform for competitive intelligence against KrisAI AdCraft
  • Circumvent usage limits, rate limits, or access controls
  • Resell or sublicense access to the Platform without written permission

6. AI-Generated Content

6.1 Ownership

Subject to these Terms, you own the output content (ad copy, images, audio) generated by the Platform using your inputs. We do not claim ownership of your generated content.

6.2 Your Responsibility

You are solely responsible for reviewing, approving, and ensuring the accuracy, legality, and compliance of all AI-generated content before publishing or using it in any campaign. AI outputs may contain errors, inaccuracies, or legally non-compliant content. Always review outputs before use.

6.3 No Guarantees on Output

We do not warrant that AI-generated content will be accurate, free of errors, legally compliant, or suitable for your specific use case. Campaign results (CTR, CPL, ROAS) displayed are based on historical data and are not guarantees of future performance.

6.4 Third-Party AI Models

AI generation uses third-party models (Anthropic, OpenAI, fal.ai). Their respective terms of service and content policies also apply to generated outputs. We pass your inputs to these services as described in our Privacy Policy.

7. Ad Platform Integrations

To publish campaigns on Meta, Google Ads, or LinkedIn, you must connect your platform accounts via OAuth. By connecting these accounts, you authorize KrisAI AdCraft to act on your behalf within the scopes you grant.

  • You remain solely responsible for your ad accounts, budgets, and spend on third-party platforms.
  • KrisAI AdCraft is not liable for charges incurred on Meta, Google, or LinkedIn as a result of campaigns launched through the Platform.
  • Platform APIs may change or be revoked; we do not guarantee uninterrupted integration functionality.
  • You must comply with the terms of service of each connected ad platform.

8. Intellectual Property

8.1 Our IP

The Platform, including its software, design, trademarks, logos, and all underlying technology, is owned by KrisAI AdCraft and protected by intellectual property laws. Nothing in these Terms grants you any rights in our IP except the limited license to use the Platform.

8.2 Your Content

You retain ownership of content you upload or input into the Platform ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to process it solely to provide the Service to you.

8.3 Feedback

If you provide us with feedback or suggestions about the Platform, you grant us the right to use that feedback without restriction or compensation to you.

9. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described therein.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRISAI ADCRAFT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless KrisAI AdCraft and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your User Content; (d) your ad campaigns or any content published on third-party platforms; or (e) your violation of any third-party rights.

13. Termination

  • You may terminate your account at any time by contacting us or using the account deletion option in settings.
  • We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law.
  • Upon termination, your right to use the Platform ceases immediately. We will delete your data within 30 days as described in the Privacy Policy.
  • Sections 8, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved by binding arbitration under the American Arbitration Association (AAA) Commercial Rules, with proceedings conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a banner in the dashboard at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must cancel your subscription before they take effect.

16. Miscellaneous

  • Entire Agreement — These Terms and the Privacy Policy constitute the entire agreement between you and KrisAI AdCraft regarding the Platform.
  • Severability — If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No Waiver — Our failure to enforce any right or provision does not constitute a waiver.
  • Assignment — You may not assign these Terms without our consent. We may assign our rights to a successor in connection with a merger or acquisition.
  • Force Majeure — We are not liable for failures caused by events beyond our reasonable control.
